Terms of Service

1. ACCEPTANCE OF TERMS
Digital Media Expressions provides its Services to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS on this web site or request a copy from us at any time. By using the services of Digital Media Expressions, you agree to be bound by our Terms of Service.

2. CONTENT AND COPYRIGHT DISCLAIMER
It is your responsibility to provide us with all Material (or "Content") to be used for your project. You certify that you are the owner of all Material submitted to us, or that you have obtained permission from the copyright owner to use any Content, including, but not limited to, photographs, clip art, graphics, animations, video (analog or digital), music and/or text. You are solely responsible for, and assume all copyright liability for all Content you submit.

You agree to indemnify and hold Digital Media Expressions, and its respective representatives, licensees, successors, subsidiaries, affiliates, officers, agents or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to, or arising out of, Content you provide, your use of our Services, your connection to the Services, your violation of the TOS, or your violation of any rights of another.

Digital Media Expressions reserves the right to refuse service for any reason. Digital Media Expressions will not acknowledge any request for morally objectionable or potentially illegal services, nor accept any questionable content for inclusion.

3 . QUALITY
The quality of a finished production is frequently determined by the quality of the content provided. Digital Media Expressions will make every effort to enhance the quality of all content for media viewing. However, best results will be obtained with your submission of the highest quality media you can provide.

4. LIMITATION OF LIABILITY
You expressly understand and agree that Digital Media Expressions shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages to, theft or loss of the Content you provide, damage to DVD players, computers, or other equipment, loss of profits, goodwill, use, data or other intangible losses, resulting from, but not limited to, product defects, accident, misuse, acts of God or other circumstances.

5. GENERAL INFORMATION
The TOS and the relationship between you and Digital Media Expressions shall be governed by the laws of the State of Florida , without regard to its conflict of law provisions. You and Digital Media Expressions agree to submit to the personal and exclusive jurisdiction of the courts located within the Pinellas County, Florida, United States of America.

By using our Services, you acknowledge that you have read and accepted the TOS, which constitutes the entire agreement between you and Digital Media Expressions, and governs your use of the Services, superceding any prior agreements between you and Digital Media Expressions (including, but not limited to, any prior versions of the TOS).
